1. Acceptance of these terms
By downloading, installing, accessing, or using PhotoSure, you confirm that you have read and agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the app. PhotoSure is provided by the developer identified on its App Store product page.
2. Eligibility and accounts
You must have the legal capacity to accept these terms under applicable law. A minor should use PhotoSure only with a parent or guardian's permission and guidance. The current release does not require an account. You remain responsible for securing your device, system credentials, and local media.
3. Limited license
Subject to these terms and applicable App Store rules, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use PhotoSure on compatible Apple devices that you control.
Except where applicable law expressly permits it, you may not copy, rent, sell, distribute, bypass security controls, reverse engineer, or attempt to obtain the source code of PhotoSure.
4. Automated analysis and recommendations
Duplicate, similarity, burst, blur, file-size, and quality results are generated automatically. They may be incomplete, inaccurate, or unsuitable for your personal judgment. A recommended keep, default removal selection, or category is a reversible suggestion and is not a guarantee that an item is the “best” photo or is safe to delete.
PhotoSure does not automatically delete media based on analysis results. You are responsible for inspecting thumbnails, previews, categories, sizes, and availability states, and for deciding what to keep, protect, or add to the cleanup set.
5. Cleanup, deletion, and recovery
The deletion flow requires you to select items, inspect the cleanup set, and approve the final Apple Photos system prompt. Deleted items normally move to Recently Deleted, but Apple Photos and your iCloud settings control exact behavior, retention, synchronization, and recovery.
Before deletion, confirm that important media has a usable independent backup. PhotoSure cannot guarantee recovery of deleted, synchronized, offline, unavailable, or damaged media.
6. Privacy Space
Privacy Space creates a verified encrypted local copy on the current device. Importing does not automatically delete the Apple Photos original or alter your current cleanup selections unless you separately take those actions.
Privacy Space is not a backup service, cloud drive, or cross-device synchronization service. Removing PhotoSure or its app data, losing the device, device failure, loss of the encryption key, or system cleanup may make protected media permanently unavailable. Maintain an independent backup of important media.
7. Permissions, devices, and availability
Some features require Photo Library, notification, local authentication, available-storage, or background-refresh access. Limited Photo Library access restricts analysis to selected items. Media stored only in iCloud and not downloaded to the device may be unavailable for analysis or import.
iOS controls background execution, system confirmations, notification delivery, library synchronization, and resource availability. Scheduled checks and reminders are provided on a best-effort basis. System updates, permission changes, Low Power Mode, thermal conditions, storage capacity, and library size may affect performance.
8. Acceptable use
You may not:
- Access, process, or delete media you are not authorized to control;
- Violate another person's privacy, copyright, or other legal rights;
- Disrupt, misuse, or bypass security measures in PhotoSure or the Apple platform;
- Use PhotoSure for unlawful, fraudulent, or harmful activity.
9. Intellectual property
PhotoSure's software, interface, brand, logo, copy, and related materials are owned by their respective rights holders and protected by applicable intellectual property laws. You retain the rights you already hold in your photos, videos, and other content.
10. Service limitations and disclaimer
To the maximum extent permitted by applicable law, PhotoSure is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation, perfect detection, access to every file, exact agreement between estimated and final reclaimed capacity, or recovery of any media.
Nothing in these terms excludes or limits statutory warranties, consumer rights, or liabilities that applicable law does not permit us to exclude.
11. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, or consequential loss caused by an incorrect selection, lack of backup, Apple Photos or iCloud behavior, device failure, permission changes, loss of an encryption key, or events beyond our reasonable control.
If applicable law does not permit a particular limitation, that limitation applies only to the extent legally allowed and does not affect mandatory consumer rights.
12. Changes and termination
We may update these terms for product, legal, or security reasons and will revise the effective date above. Continued use of an updated release means that you accept the revised terms. If you do not agree, stop using and uninstall PhotoSure.
We may terminate the license where permitted by law if you materially breach these terms. Before uninstalling, address Privacy Space copies and any backups you need.
13. Governing law
To the extent permitted by applicable law, these terms are governed by the law of the location of the developer identified on the App Store product page. Mandatory consumer, privacy, and other protections in your jurisdiction continue to apply.
